Labour DisputesA dispute is any severe discrepancy between two or more parties. Such commercial disputes tend to commonly rise in the workplace, as many employers and employees fail to strike a balance amongst themselves.

Despite countless efforts to even out and neutralise the playing field, a hierarchy develops and more often than not, a waging war ensues between higher management and those typically described as ‘workers on the floor’.

However, the Labour Relations Act sets out certain procedures which can be used to decide disputes of importance. This Act applies to all employers, workers, trade unions and employers’ organisations and is aimed at the enforcement of fair labour practices.

Every worker has the right not to be unfairly dismissed and depriving such employees of this right can flare up in a workplace quarrel. Despite the fact that there are certain means available in the case of workers who must be dismissed for fair and sound reasons, there still arises a problem when dismissals occur for no legitimate purpose. The situation can also be turned around, where employees lodge false complaints against their employers, in order to sneakily climb the corporate ladder.
